A hit-and-run crash in Brooklyn killed a Lyft driver and injured two others early Monday, October 5. According to police, a 2026 Audi A5 traveling south on Ocean Parkway rear-ended a 2023 Toyota Camry near Avenue S shortly after midnight. The impact sent the Camry spinning into a 2021 Toyota RAV-4, causing both vehicles to veer off the road and hit trees. Both reportedly had New York City Taxi and Limousine Commission (TLC) license plates.
The Camry driver, a 62-year-old Brooklyn man, was transported to Maimonides Medical Center, where he was pronounced dead. His 39-year-old rear passenger was hospitalized with serious neck and back injuries. The 25-year-old RAV-4 driver sustained minor injuries.
Police say the Audi driver abandoned the vehicle, removed the license plates, and fled the scene. Witnesses reported seeing at least five people exit the vehicle and that the driver was seen getting into and leaving the scene in another vehicle, though police have not confirmed these accounts.
Residents say speeding drivers have been an issue in the area for some time. Along this same stretch last March, a speeding driver killed a mother, two of her children, and injured a third, while out walking.
The crash remains under investigation, and police are still searching for the Audi driver.
What Happens When a Driver Flees a Serious Accident in New York?
New York law requires all drivers to stop and remain at the scene of an accident. Leaving the scene can result in criminal charges, and more serious penalties when a crash causes serious injuries or death.
“Fleeing” also does not eliminate a driver’s civil liability. If the driver is identified, you or surviving family members can seek compensation for your injuries and losses.
What if the Hit-and-Run Driver Is Never Found?
If a hit-and-run driver cannot be identified, you still have options for recovering compensation. Depending on the circumstances, your own uninsured motorist coverage may apply when the responsible driver is unknown or uninsured.
For drivers without applicable auto insurance coverage, New York’s Motor Vehicle Accident Indemnification Corporation (MVAIC) may provide another potential source of compensation.
How Does TLC or Rideshare Insurance Affect a Brooklyn Accident Claim?
Rideshare and other for-hire vehicles may have additional insurance coverage that applies when a driver is working or transporting a passenger. The available coverage depends on the driver’s status and the circumstances at the time of the crash. A lawyer can review the insurance policies and determine which sources may be applicable.
Can a Passenger Injured in a Hit-and-Run Seek Compensation?
Yes, injured passengers can pursue compensation from the responsible driver and other liable parties, as well as through available insurance coverage. In hit-and-run crashes involving a rideshare or TLC-licensed vehicle, no-fault benefits, commercial insurance, and uninsured motorist coverage may all be sources of compensation.
What Rights Does the Family of a Rideshare Driver Killed in a Crash Have?
When a negligent driver causes someone’s death, the estate’s representative can file a “wrongful death claim” on behalf of eligible surviving family members.
Compensation typically includes funeral expenses, loss of financial support and services the deceased provided, and other losses, depending on the circumstances. A separate “survival action” may also seek compensation for the deceased’s pain and suffering before death.
How Long Do You Have to File a Hit-and-Run or Wrongful Death Claim in New York?
You have three years to file a personal injury claim in New York, and two years from the person’s death to file a wrongful death claim. Hit-and-run, no-fault, uninsured motorist, and MVAIC claims, however, have shorter notice and filing requirements, so it is important to contact a lawyer as soon as possible after the collision.
